Please read the following terms of use, conditions, and disclaimer ("Agreement") carefully before participating in any online programs or challenges presented by Dr. Fitology ("Website" or "Mobile App"). By participating in the programs and challenges provided by Adrian Salavaty ("Adrian Salavaty" or "I"), you acknowledge and agree to the terms and conditions outlined in this Agreement. Scope of Services:

(a) Dr. Fitology, available through the Website (www.DrFitology.com) and the Mobile App, presents online programs and challenges designed by Adrian Salavaty for informational and educational purposes.

(b) Adrian Salavaty is not a licensed healthcare professional and does not provide medical advice. The online programs and challenges are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

(c) Participants agree to assume all risks associated with participating in the online programs and challenges and release Dr. Fitology, Adrian Salavaty, and their respective affiliates, employees, agents, and representatives from any liability for any injuries, damages, or losses that may occur as a result of their participation.

 

Limitation of Liability:

(a) To the fullest extent permitted by law, Dr. Fitology, Adrian Salavaty, and their respective affiliates, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the participation in the online programs and challenges, including but not limited to injury, loss of data, loss of profits, or any other damages.

(b) Dr. Fitology, Adrian Salavaty, and their respective affiliates, employees, agents, and representatives shall not be responsible for any errors or omissions in the online programs and challenges, or for any actions taken by participants based on the information provided.

(c) The total liability of Dr. Fitology, Adrian Salavaty, and their respective affiliates, employees, agents, and representatives, whether in contract, warranty, tort (including negligence), or otherwise, shall be limited to the amount paid, if any, by the participant for the online programs and challenges.

 

Indemnification:

Participants agree to indemnify, defend, and hold harmless Dr. Fitology, Adrian Salavaty, their affiliates, employees, agents, and representatives from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or in connection with their participation in the online programs and challenges.

The Website, Mobile App, and other online platforms utilized by Dr. Fitology may contain content or links to third-party websites, social media platforms, or other resources. Dr. Fitology and Adrian Salavaty do not endorse, control, or assume any responsibility for such third-party content or links. Participants acknowledge and agree that their use of any third-party content or links is at their own risk.

 

Modifications to the Agreement:

Dr. Fitology and Adrian Salavaty reserve the right to modify, update, or change the terms of this Agreement at any time without prior notice. Participants are responsible for reviewing the Agreement periodically to stay informed about any changes.

 

Governing Law and Jurisdiction:

This Agreement shall be governed by and construed in accordance with the laws of Australia. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.

 

By participating in any online program or challenge presented by Dr. Fitology, either through the Website, Mobile App, or any other means, you acknowledge that you have read, understood, and agreed to the terms and conditions set forth in this Agreement. If you do not agree with any part of this Agreement, you should refrain from participating in the programs and challenges. It is your responsibility to review this Agreement periodically for any updates or changes.
